Diaz wins "topless" battle [ 2006-04-04 10:08 ]

Cameron Diaz's topless
pictures battle is over.A Los Angeles judge awarded the "In Her Shoes" star undisclosed statutory damages after a photographer tried
to sell semi-naked photos and videos of her - taken before she was
famous.
John Rutter has already been jailed for attempting to blackmail Diaz to buy back the images for
$3.3 million.
When she refused, he threatened to sell them to a European advertising
agency for $5 million.
The actress then sued him for $5 million for unauthorized commercial
use of her name and image. Last July (05), Rutter was eventually
convicted of charges of forgery, perjury and attempted grand larceny.
He then tried to counter
sue her for $10 million claiming she showed an interest in
buying the pictures and lured him into a trap.
In his ruling last Thursday (30.03.06), the judge also dismissed a
countersuit from the photographer who accused Diaz of fraud and
breach of contract.
The judge in the civil case also issued a permanent injunction banning
any sale, license or use of the photos and videotape.
A further ruling is expected in the future to decide whether Rutter
must also pay for Diaz's legal bill.
