為貫徹落實中共中央辦公廳、國務(wù)院辦公廳印發(fā)的《保護司法人員依法履行法定職責(zé)規(guī)定》，最高人民法院日前發(fā)布了《人民法院落實〈保護司法人員依法履行法定職責(zé)的規(guī)定〉的實施辦法》（以下簡稱《辦法》），并同步發(fā)布司法人員履職保障十大典型案例。

The Supreme People's Court on Tuesday published a document on improving the mechanism to protect judges and their associates in fulfilling their legal duties. It stipulates that when handling cases, judges should not be subject to interference from other government organs, social organizations or individuals.
最高人民法院7日發(fā)文，落實保障司法人員依法履行職責(zé)的機制。文件強調(diào)，法官辦案時不受行政機關(guān)、社會團體和個人的干涉。

《辦法》共二十四條，涉及免受干預(yù)（free from interference）、免責(zé)機制（mechanism of accountability exemption）、救濟渠道（redress mechanism）、公正考核（impartial assessment）、安全保障（safety protection）、休假權(quán)利（vacation entitlement）、薪酬保障（salary guarantee）等內(nèi)容，是對《保護司法人員依法履行法定職責(zé)規(guī)定》的細(xì)化和落實。

內(nèi)容要點包括：

Judges have the right to refuse to follow any requests by any organization or individual that are without legal mandate or due process.
法官有權(quán)拒絕執(zhí)行任何單位、個人違反法定職責(zé)或者法定程序、有礙司法公正的要求。

Judges are also entitled to refuse to comment on cases which are not in a judicial process or trials that they do not participate in.
法官有權(quán)拒絕就尚未進入訴訟程序的案件或者本人未參與審理的案件發(fā)表意見。

They are entitled to make complaints against nine types of action by governmental agencies or staff, including intervention in judicial process, obstruction of justice and restraint or suppression of the judges' independent expression of opinion.
法官有權(quán)對國家機關(guān)或工作人員的九種行為提出控告，包括：干預(yù)司法活動；妨礙司法公正；限制或者壓制法官獨立、充分表達對參與審理案件的意見；等等。

All courts should have committees to protect judges' safety, rights and interests.
所有法院都應(yīng)設(shè)立保護法官安全和權(quán)益的委員會。

Judges and their associates should also be provided with recording devices at their workplace.
應(yīng)該為法官和司法人員提供錄音錄像設(shè)備。

Those found guilty of interfering in judicial affairs, including threatening, insulting or harming judges, will face severe punishment.
威脅、辱罵或傷害法官等干預(yù)司法公正的行為將受到嚴(yán)懲。

Personal information of judges and their families should be protected.
法官及其家屬的個人信息應(yīng)受到保護。
